IROCC is aware that the federal statute establishing program qualifications has recently been modified. These changes require subsequent modifications to the administrative rules governing our program We will provide revised guidelines as they become effective and ask that applicants remain patient as were carry out this transition.
Under
the “Law Enforcement Officers Safety Act” (HR-218) qualified active and
retired law enforcement officers are permitted to carry concealed
handguns nationwide. The law amends the Gun Control Act (18 U.S.C.
Chapter 44) to exempt qualified active and retired law enforcement
officers from state and local laws prohibiting the carry of concealed
firearms.
In
accordance with the Federal Act,
Illinois passed Public Act 94-103 (2005) that provides for the annual
certification of retired law enforcement officers qualified under
federal law to carry a concealed weapon.

Guidelines for Qualifications of Federal Law Enforcement Officers
On July 22, 2004, Congress passed, and the President signed, the Law Enforcement Officers Safety Act of 2004 (the "Act"), Pub. L. No. 108-277, 118 Stat. 865 (2004), codified at 18 U.S.C. §§ 926B and 926C. With certain limitations and conditions, the Act exempts active and retired "qualified law enforcement officers" ("qualified LEOs") from state laws and local ordinances prohibiting the carrying of concealed weapons. The Act does not purport to affect any state or local laws and ordinances that permit restrictions of concealed firearms on private property or any such laws that restrict the possession of firearms on any State or local government property, installation, building, base, or park.
